This research aims to: (1) analyze the legal issues related to the issuance of licenses for operational personnel under the Draft Rail Transport Act B.E. …; (2) study the concepts, theories, definitions, and substantive provisions of the Draft Rail Transport Act B.E. … concerning the licensing of operational personnel; and (3) examine the differences between the licensing of operational personnel under Thai law and foreign legal systems.
This study adopts a qualitative legal research methodology, emphasizing documentary research on both Thai and foreign legal instruments related to rail transport, totaling 22 legislative documents—comprising 7 Thai laws, 5 from the United Kingdom, 6 from Japan, and 4 from the European Union. The researcher conducted qualitative synthesis and analysis of the contents derived from legal documents and literature review to establish a comparative analytical framework between Thai law and the laws of the United Kingdom, Japan, and the European Union. The purpose was to propose recommendations for improving the Draft Rail Transport Act to align with international standards and the principles of public governance.
The findings suggest that the Draft Act should include provisions requiring the positions of station master or chief station officer to be subject to licensing, as well as stipulate minimum qualifications such as age and educational level. These measures would enhance the efficiency and safety of rail transport personnel supervision and strengthen public confidence in the regulatory framework governing the rail transport system.
