The English Common Law Approach to Flooding Nuisance Case

Abstract
Not all floods are caused by nature, but mankind’s activities also affect floods. The English common law on flooding nuisance is a long-established area of environmental law where a flood event can have far reaching effects on people and the environment. This is obviously important for property rights issues such as the rights to defend their own property from flooding and the unlawful interference with a person’s use or enjoyment of their own property. This academic article aims to briefly examine common law on flooding nuisance under the English legal system that shall reflect a balance between the rights to protect property from flooding and the duty to take [reasonable] flood defence action.
